Legal framework and the managing agent’s liability
Duty to advise and to remain vigilant
The professional managing agent acts as agent for the co-owners' association (Act no. 65-557 of 10 July 1965 and the ALUR Act). As such, it must inform co-owners of any risk liable to affect the safety of the building and the preservation of its value.
Risk statement (ERP) when a unit is sold
When a co-owner sells their unit, the risk and pollution statement (ERP, Act of 30 July 2003) must be provided less than 6 months before the preliminary sale agreement. The managing agent may be asked to supply the information known about the building. See errial.georisques.gouv.fr.
The Paris IGC — the official authority
L'Inspection Générale des Carrières (86 rue Regnault, 75013 Paris) is the reference body for ground movement linked to former quarries. In the event of damage, call 3975. An official consultation costs €10 and is issued within 30 days on average.
Frequently asked questions
Can the pre-assessment be relied on at a general meeting?
The pre-assessment is an informative, decision-support document. It has no regulatory force (that lies with the official IGC consultation), but it can be appended to the general meeting notice as a preparatory document for a resolution vote.
Can it be charged to the co-ownership?
There is nothing to prevent it. As the pre-assessment is an audit service in the interests of the co-ownership, its cost can be charged to common expenses (article 44 of Decree no. 67-223), subject to the co-owners' committee’s agreement or a vote at the general meeting, depending on the firm’s practice.
How many buildings can be audited at once?
